1. Agreement to Terms
By accessing or using the services provided by Atlas Studio Digital ("we," "our," or "us"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access our services.
These Terms and Conditions constitute a legally binding agreement between you and Atlas Studio Digital regarding your use of our web design services.
2. Services Description
Atlas Studio Digital provides professional web design and development services, including but not limited to:
- Custom website design and development
- Website revamp and redesign
- Landing page design
- E-commerce website solutions
- Website maintenance and support
- Search engine optimization (SEO)
- Content management system integration
The specific services to be provided will be detailed in your project proposal or statement of work.
3. Payment Terms
3.1 Pricing
All prices are listed in Malaysian Ringgit (RM) and are exclusive of any applicable taxes. The total project cost will be specified in your project proposal.
3.2 Payment Schedule
Payment is required as follows:
- All Packages: 50% deposit to begin work, 50% upon completion before handover
- Monthly Add-ons: Billing starts after website launch, not during the build phase
3.3 Late Payments
Late payments may result in project delays or suspension of services. A late fee of 1.5% per month may be applied to overdue balances.
3.4 Refund Policy
Due to the nature of digital services, refunds are provided on a case-by-case basis. If work has not commenced, a full refund may be issued. If work has begun, refunds will be prorated based on completed work.
4. Project Timeline
Project timelines are estimates based on the scope of work defined in your proposal. Typical delivery times are:
- Starter Package: 14 business days
- Professional Package: 21 business days
- Business Package: 4 weeks
- E-Commerce Package: 8 weeks
Timelines may be extended if:
- Client feedback or content is delayed
- Scope changes are requested
- Technical complications arise
- Third-party integrations require additional time
5. Client Responsibilities
The client agrees to:
- Provide all necessary content (text, images, logos) in a timely manner
- Provide timely feedback on design mockups and revisions
- Review and approve work at designated milestones
- Maintain backup copies of their website content
- Ensure all provided content does not infringe on third-party rights
- Obtain necessary licenses for any third-party materials
Delays in providing required content or feedback may result in project delays and additional charges if the project extends beyond the agreed timeline.
6. Revisions and Changes
6.1 Included Revisions
Each package includes a specified number of revision rounds:
- Starter: 2 revision rounds
- Professional: 3 revision rounds
- Business: 3 revision rounds
- E-Commerce: As specified in proposal
6.2 Additional Revisions
Additional revisions beyond the included rounds will be charged at our standard hourly rate. We will notify you before any additional charges are incurred.
6.3 Scope Changes
Changes that go beyond the original project scope may incur additional charges. We will notify you of any additional costs before proceeding with the work.
7. Intellectual Property
7.1 Ownership Transfer
Upon full payment, the client receives full ownership rights to the final website design and code specifically created for their project. This does not include:
- Third-party plugins or software
- Stock photography or licensed assets
- Proprietary tools or frameworks we use
7.2 Portfolio Rights
We reserve the right to display completed work in our portfolio and marketing materials unless otherwise agreed in writing.
8. Warranty and Support
8.1 Post-Launch Support
Each package includes a post-launch support period to fix any bugs or errors at no additional cost:
- Starter: 30 days post-launch support
- Professional: 60 days post-launch support
- Business & E-Commerce: 90 days post-launch support
The support period covers:
- Coding errors
- Functionality issues
- Browser compatibility problems
The support period does not cover:
- New feature requests or design changes
- Issues caused by third-party modifications
- Hosting or server-related problems
- Content updates
8.2 Ongoing Support
After the support period, ongoing support is available through our Website Maintenance add-on (RM180/month) or at our standard hourly rate.
9. Limitation of Liability
To the maximum extent permitted by law, Atlas Studio Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to our services.
Our total liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific project giving rise to the claim.
We do not guarantee specific business results, search engine rankings, or revenue increases from our web design services.
10. Termination
Either party may terminate the project by providing written notice. In the event of termination:
- Client pays for all work completed up to the termination date
- We deliver all completed work to the client
- No refunds for work already performed
11. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
